
Scope
These General Terms and Conditions (GTC) apply to all contracts concerning the temporary rental of apartments for accommodation purposes, as well as all related services and deliveries between Da Alois GmbH (hereinafter referred to as “provider”) and the guest (hereinafter referred to as “customer”).
Conclusion of Contract
The contract is concluded upon acceptance of the customer’s booking request by the provider. The booking can be made in writing, by telephone, by email, or via online booking systems. By placing a booking, the customer accepts these terms and conditions.
Prices and Payment Terms
All prices include statutory VAT. Payment of the agreed price must be made in cash upon arrival or in advance via bank transfer. For bookings made through online booking platforms, the payment conditions stated there apply.
Cancellation and Withdrawal
Cancellations made up to 28 days prior to arrival are free of charge.
However, if the booking was made via our own website, only 98% of the booking amount will be refunded in the event of a cancellation.
This is because our external payment processor charges a non-refundable transaction fee, which the provider cannot absorb.
For cancellations made later than 28 days before arrival or in case of no-show, 100% of the total amount will be charged.
Cancellations must be made in writing. Different cancellation conditions may apply to special offers and bookings made through certain platforms.
Arrival and Departure
Apartments are available from 4:00 p.m. on the day of arrival. Check-in is handled via a self-check-in system. On the day of departure, the apartment must be vacated by 10:00 a.m. at the latest. Any extension of the stay requires the provider’s approval.
Use of the Apartments
Apartments may only be occupied by the number of people specified in the booking. Pets are only allowed upon prior arrangement and for an additional fee. Smoking is not permitted in the apartments. The customer is liable for any damage caused by themselves or their invited guests.
Liability of the Provider
The provider is liable only for intent and gross negligence. The provider accepts no liability for loss or damage to valuables, unless there has been a breach of the provider’s duty of care.
Data Protection
The provider processes the customer’s personal data solely for the purpose of handling the booking, and in accordance with applicable data protection laws. For more information, please refer to our privacy policy available on our website.
Force Majeure
In cases of force majeure that significantly hinder or make the fulfilment of the contract impossible, the provider is entitled to terminate the contract without any obligation to pay compensation.
Place of Jurisdiction and Applicable Law
The place of jurisdiction is the location of the provider’s registered office. Austrian law applies.
Severability Clause
If any provision of these terms and conditions is or becomes invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the valid regulation that comes closest to the intended economic purpose shall apply.
